THE PURPOSE OF THIS PROCEDURE IS TO GUIDE AN INSPECTOR THROUGH THE PROCESS required when Limitation, suspension or revocation of an Examiner certificate or privileges is required.

 

If, during oversight or by any other means, evidence is found that shows a non-compliance with the applicable requirements by a person holding an Examiner certificate, the Authority shall raise a finding, record it and communicate it in writing to the Examiner.

When such finding is raised, the competent authority shall carry out an investigation. This investigation shall include, but is not limited to, a statement from the Examiner and review of all documentation involved. It may also include statements from other parties suspected to be involved.

The following list is examples that will rise a finding:

(1) obtaining the Examiner certificate by falsification of submitted documentary evidence;

(2) falsification of the logbook and licence or certificate records;

(3) the certificate holder no longer complies with the applicable requirements of Part-FCL;

(4) exercising the privileges of an examiner certificate when adversely affected by alcohol or drugs;

(5) non-compliance with the applicable operational requirements;

(6) evidence of malpractice or fraudulent use of the certificate

(7) unacceptable performance in any phase of the flight examiner’s duties or responsibilities.

(8) Performing tests, checks or assessments without having the required privileges.

The competent authority may limit, suspend or revoke an Examiner certificate upon the written request of the certificate holder.

All skill tests, proficiency checks or assessments of competence conducted during suspension or after the revocation of an examiner’s certificate will be invalid.

If the Examiner involved is non-Danish, the competent authority of this Examiner must be informed.

Whenever it is expected that any kind of limitations will be the outcome of a finding, legal department must be involved. Together with legal department a plan must be constructed that prevents the continuation of the non-compliance  Enforcement measures will be performed by legal department.

Note that all limitation, revocation and suspension of any privileges must be performed according to procedure 3032.
